1. Subject and scope
1.1 These general terms and conditions govern the contractual relationship between:
- on the one hand, the natural or legal person ordering services from "Certificat PEB Brussels", in their own name or on behalf of third parties, for professional or private purposes; hereinafter referred to as "The Client", and
- on the other hand, CERTIFICAT PEB BRUSSELS, commercial name of SOGEX & Co sprl, with registered office at Rue Colonel Bourg 110 bte 4, 1030 Brussels, VAT BE 0886 658 964, hereinafter referred to as "The Auditor".
1.2 These terms apply to any order for services (EPC certificates for existing residential buildings, energy advice, etc.) via www.certificatpeb.brussels, by phone, email or via the contact form.
2. General provisions
2.1 These terms apply to every service order. The Auditor reserves the right to amend them. New terms only apply to orders placed after their communication to the Client.
2.2 The Client is deemed to have read and accepted all clauses, unless expressly agreed otherwise in writing.
2.3 Quotes are drawn up in French, valid for 10 calendar days and confidential.
2.4 An order only binds the Auditor after written confirmation. Filling in a booking form (e.g. via Calendly) is not sufficient to conclude a contract.
3. Performance conditions
Documents: The Client must collect acceptable evidence and provide it before or during the visit. Documents submitted after the issue of the final EPC certificate will incur a minimum surcharge of €145 excl. VAT.
Accessibility: The Client must provide easy, safe and complete access to all areas of the building. In case of failure, the Auditor may stop the mission, with the full amount remaining due.
Objectivity: The mission is carried out with complete objectivity. The report is automatically generated by Brussels Environment software; the Auditor cannot modify the result.
Report: Services are drawn up in French and sent by email after full payment. After sending, no modifications are possible (unless the error is the Auditor's), except against a minimum of €145 excl. VAT.
4. Cancellation
Cancellation at least 48 working hours before the visit: Invoicing at 50% of the ordered amount, unless a new appointment is made within 15 days of the cancelled appointment.
Cancellation on the day / no-show / technical impossibility: Invoicing at 100% of the ordered amount. Travel costs remain due.
5. Price, surcharge, payment, invoicing
The price may be adjusted upward if actual data differs from information provided at the time of ordering (gross floor area, annexes, property type, etc.).
Price list available at www.certificatpeb.brussels. Unless otherwise stated, prices are VAT inclusive and expressed in euros.
Calculation: Prices are calculated based on gross living area (walls included), not net habitable area.
Payment: At the end of the visit, in cash, via banking app or bank transfer.
Additional services: Additional travel: €75 excl. VAT · Duplicate (> 30 days): €21 excl. VAT · Paper version: €29 excl. VAT · Invoice amendment: €13.22 excl. VAT.
Any unpaid invoice after 15 days automatically incurs late interest, a lump-sum indemnity and reminder fees (€16.52 excl. VAT/letter + €45 excl. VAT/formal notice).
6. Obligations and liability
Any complaint must be submitted in writing within 15 calendar days of the certificate being delivered. After this deadline, the certificate is deemed accepted.
The Auditor accepts no liability for losses resulting from the Client's failure to meet their obligations, or from incorrect, incomplete or false information provided by the Client.
7. Force majeure
In the event of force majeure, the Auditor will immediately contact the Client to schedule a new appointment, without compensation.
8. Applicable law and dispute resolution
Any dispute will preferably be resolved amicably. If the conflict persists, Belgian law applies, exclusively before the French-speaking courts of Brussels, in the French language.
9. Personal data protection – GDPR
Certificat PEB Brussels (SOGEX & Co sprl, Rue Colonel Bourg 110 bte 4, 1030 Brussels, info@certificatpeb.brussels) processes personal data for the performance of the contract, client management and accounting, in accordance with Art. 6 §1 b, c and f GDPR.
You have the right to access, rectification, erasure, restriction and portability of your data, as well as the right to lodge a complaint with the Data Protection Authority.
